Terms of Service

Ocasia is a platform that allows event organisers to collect photographs and videos from their guests.

Organisers can create events, invite participants, manage uploaded content and make event galleries available to guests.

Guests can join events, capture photographs and videos, and contribute to a shared collection.

Certain features may require payment.

You must be at least 13 years old to use Ocasia.

You must be at least 18 years old to create an organiser account or purchase paid services.

If you are under 18, you must have permission from a parent or legal guardian to use the Service.

By using Ocasia, you confirm that you meet these requirements.

Organisers are responsible for maintaining the security of their accounts and for activities carried out through them.

Guests may join events through invitation links, QR codes or other supported methods without creating a traditional account.

You agree to provide accurate information when requested and not to impersonate another person.

Organisers may control access to their events, manage participants and remove content.

We may restrict access to the Service where reasonably necessary to prevent abuse, address security concerns or enforce these Terms.

Users retain ownership of any intellectual property rights they hold in photographs, videos and other content they create or upload to Ocasia (“User Content”).

Uploading content does not transfer ownership to Ocasia or the event organiser.

Users are responsible for ensuring they have the necessary rights to upload their content.

You must not upload content that infringes another person’s copyright, privacy or other legal rights.

By uploading photographs or videos to an event, you acknowledge and agree that the content will be made available to the event organiser.

The organiser may view, download and manage content contributed to their event.

Once an event gallery is made available, other authorised participants may also be able to view and download its contents.

You grant Ocasia a non-exclusive, worldwide, royalty-free licence to store, process, reproduce, display and distribute your content as reasonably necessary to provide these features and operate the Service.

This includes generating previews, galleries, video compilations and other features associated with your event.

You also authorise the technical copies and downloads necessary to provide the sharing functionality described above.

This permission does not transfer ownership of your content.

Content downloaded by organisers or other participants may remain in their possession after it has been removed from Ocasia.

Event organisers are independently responsible for how they use photographs and videos obtained through Ocasia.

Ocasia provides the platform through which event content is collected, stored and shared. We do not determine or control how organisers independently use content after downloading it.

Ocasia does not grant organisers ownership of uploaded content or unrestricted commercial usage rights.

Organisers are responsible for obtaining any additional permissions necessary for their intended use of content, including permissions relating to copyright, privacy and data protection.

This includes use in advertising, marketing, promotional materials, commercial publications or other activities that may require additional rights or permissions.

Organisers must ensure that their use of content complies with applicable laws and respects the rights of content creators and individuals depicted.

Ocasia is not responsible for organisers’ independent use of downloaded content, except where liability arises from our own actions or cannot lawfully be excluded.

We use uploaded photographs and videos to provide, maintain, secure and improve the Service.

This includes storing and delivering content, displaying event galleries, generating compilations, processing reports and supporting technical functionality.

We may request permission from event organisers to feature selected event content in Ocasia’s promotional materials, including our website, social media and advertisements.

Where an organiser authorises such use, we will ensure that we have the necessary rights and an appropriate legal basis before using the content.

We do not claim ownership of User Content or sell uploaded photographs and videos to third parties as standalone content.

We have zero tolerance for objectionable content and abusive users.

You must not use Ocasia to upload, share or distribute:

• Illegal content or material that infringes another person’s rights.
• Harassing, threatening, abusive or discriminatory content.
• Non-consensual intimate imagery or sexually exploitative material.
• Content that exploits or endangers children.
• Content that unlawfully violates another person’s privacy.
• Fraudulent, malicious or otherwise unlawful material.

You must not interfere with the Service, attempt to bypass security measures or access events without authorisation.

We may remove content, restrict access or suspend accounts where we reasonably believe these Terms have been violated.

Organisers may review, hide or remove content uploaded to their events.

Guests may report content they consider inappropriate.

Ocasia may review reports and remove or restrict access to content where reasonably necessary to protect users, enforce these Terms or comply with applicable laws.

We do not undertake to review every photograph or video uploaded to the Service.

Nothing in these Terms limits our legal obligations concerning unlawful content or user safety.

Some Ocasia features require payment.

Prices and applicable charges will be displayed before purchase.

Payments made through the iOS application are processed by Apple and may be subject to Apple’s applicable payment terms.

Purchases made through other payment methods may be subject to additional terms presented during checkout.

Unless otherwise stated, purchases are one-time payments rather than recurring subscriptions.

Refunds and cancellations are handled in accordance with applicable consumer protection laws and the relevant payment arrangements.

Where a statutory cancellation right applies, we will provide the required information before purchase.

Where applicable, we may request your express agreement to begin providing digital content or services during a statutory cancellation period and explain how this affects your cancellation rights.

Nothing in these Terms excludes or restricts your statutory consumer rights.

Ocasia provides storage and access to event photographs and videos as part of the Service.

We do not guarantee that photographs, videos or other content will remain available indefinitely.

Content may remain available while the associated event or organiser account is active, subject to our storage policies and the continued operation of the Service.

We may introduce or modify reasonable storage limits, retention periods and content availability policies.

Where changes materially affect existing content, we will provide reasonable advance notice and an opportunity to download affected content where practicable and legally required.

We may remove content where reasonably necessary for security, legal compliance, abuse prevention or enforcement of these Terms.

Organisers and guests are encouraged to download and maintain their own copies of important content.

We take reasonable measures to protect stored content but cannot guarantee that technical failures or other circumstances will never result in data loss.

Our retention and deletion practices are explained further in our Privacy Policy.

Organisers may delete their events and accounts through the available account management features.

Deleting an event may permanently remove its photographs, videos and associated information from Ocasia.

Deleted content may remain temporarily in backups or other systems where reasonably necessary for technical, security or legal purposes.

Guests may request the removal of content through available reporting features or by contacting us.

Deleting content from Ocasia does not automatically remove copies previously downloaded or shared by organisers or other participants.

Ocasia cannot guarantee the deletion of copies held independently by third parties.

Any requests involving personal data will be handled in accordance with applicable data protection law.

The Ocasia name, branding, software, interface, designs and other materials provided by us are owned by or licensed to Kanea Studio Ltd.

We grant you a limited, non-exclusive, non-transferable licence to use the Service for its intended purposes in accordance with these Terms.

You may not copy, redistribute, reverse engineer or commercially exploit our software or branding except where permitted by law or with our written permission.

These restrictions do not apply to User Content you own or are otherwise authorised to use.

We process personal information in accordance with our Privacy Policy, available at:

Our Privacy Policy explains what information we collect, how we use it, how long we retain it and the rights available to individuals.

Nothing in these Terms removes or restricts rights provided by applicable data protection law.

We aim to provide a reliable Service but cannot guarantee uninterrupted or error-free availability.

The Service may occasionally be unavailable because of maintenance, technical failures or circumstances beyond our reasonable control.

We may update, modify or discontinue features to improve functionality, address security concerns or meet legal requirements.

Where changes materially affect paid features or contractual rights, we will comply with applicable consumer protection laws, including any applicable notice, cancellation or refund obligations.

Ocasia provides a platform for collecting, storing and sharing event photographs and videos.

Users and event organisers remain responsible for their own content and activities.

To the extent permitted by law, Ocasia is not responsible for:

• How organisers independently use photographs or videos obtained through the Service.
• Unauthorised publication, distribution or commercial use of content by organisers or other users.
• Disputes between organisers, guests, photographers or other third parties concerning ownership or use of content.
• Copies of content downloaded, stored or distributed outside Ocasia.
• Losses arising from circumstances outside our reasonable control.

These limitations do not exclude liability arising from our own negligence, breach of contract or other legal obligations where such liability cannot lawfully be excluded.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or any other liability that cannot lawfully be excluded.

Nothing in these Terms affects your statutory consumer rights.

We remain responsible for reasonably foreseeable losses resulting from our breach of contract or failure to exercise reasonable care and skill, as required by applicable law.

You may stop using Ocasia at any time.

We may suspend or terminate access where reasonably necessary because of:

• Serious or repeated violations of these Terms.
• Fraudulent or unlawful activity.
• Security threats or abuse.
• Legal or regulatory requirements.

Where appropriate, we will provide an explanation and reasonable opportunity to address the issue.

We may discontinue the Service, subject to applicable law and our contractual obligations.

Where reasonably practicable, we will provide advance notice and an opportunity to retrieve content before permanent discontinuation.

We may update these Terms to reflect changes to our Service, business practices or legal obligations.

The updated Terms will include a revised effective date.

Where changes materially affect users’ rights or obligations, we will provide appropriate notice.

Where required by law, we will obtain agreement to the updated Terms before they apply.

Changes will not retrospectively remove statutory rights or authorise new uses of content where additional permission is legally required.

These Terms are governed by the laws of England and Wales, except where mandatory consumer protection laws provide otherwise.

If you are a consumer living in Scotland or Northern Ireland, you may also bring proceedings in your local courts where applicable law permits.

Consumers living elsewhere retain any mandatory legal protections available under the laws of their country of residence.
